The Mediation Process

If you’re considering mediation, you’re likely looking for a clear understanding of what to expect.

The process is designed to be structured, efficient, and manageable from start to finish.

Whether you’re navigating a divorce or a business dispute, mediation provides a more controlled and focused way to move forward.

We work with clients across New York and New Jersey and are available via in-person or video conference appointments.

A Structured Approach from the Start

Mediation follows a clear and intentional process.

You won’t be left guessing what comes next, and you won’t be expected to resolve everything at once.

Each step is designed to build toward resolution in a way that is organized and productive.

Step 1: Initial Consultation

The process begins with a confidential consultation.

This is an opportunity to:

  • Discuss your situation
  • Ask questions
  • Understand how mediation applies to your circumstances

There’s no obligation to move forward. The goal is to provide clarity so you can make an informed decision.

Step 2: Preparation and Information Gathering

Once you decide to proceed the next step is preparation.

This may include gathering:

  • Financial information
  • Relevant documents
  • Key details related to your situation

You don’t need to have everything prepared in advance. Guidance is provided throughout this stage to ensure the process stays organized and efficient.

Step 3: Mediation Sessions

Mediation sessions are where the work of resolution takes place.

Each session is:

  • Structured and focused
  • Guided by a neutral mediator
  • Designed to keep discussions productive

The Mediator helps both parties identify the issues that need to be resolved, talk through options, and move toward practical agreements that can actually work in real life.

Step 4: Developing Resolution

As mediation progresses, the focus shifts from identifying the issues to shaping workable terms both parties can consider.  These may include:

  • Practical options for resolving each issue
  • Responsibilities, timelines, and next steps
  • Terms that reflect the needs of both parties
  • How the agreement can be carried out in real life

The goal is to move from conversation to clarity, creating a resolution that is organized, realistic, and ready to be documented.

Step 5: Formalizing the Agreement

Once all decisions are made they are documented in a clear and comprehensive written agreement.

For divorce matters mediation results in a separation agreement that will form the basis of the divorce filing.

For business matters agreements are structured to reflect the terms reached and to support implementation moving forward.

Step 6: Moving Forward with Clarity

After the agreement is finalized, you’ll have a clear path forward.

Most mediation matters are resolved within a few weeks to a few months, depending on complexity and cooperation.

The process is designed to move forward without unnecessary delay.

A More Controlled Way to Resolve Conflict

Mediation provides an alternative to the uncertainty and pressure of litigation.

It allows you to stay involved in decisions, maintain privacy, and move forward in a more structured and efficient way.

Start with a Conversation
